The Centre for Employment and Labour Relations Law will be holding their first Labour Law Seminar for the year with a panel discussion by Professor Alan Bogg (University of Bristol) and Professor Sean Cooney (University of Melbourne), chaired by Associate Professor Tess Hardy (University of Melbourne).
The panel will be discussing two recent decisions of the High Court of Australia concerned with employment status. In ZG Operations v Jamsek and CFMMEU v Personnel Contracting, the plurality judgments endorsed a contract-centric approach to characterising work relationships. This panel session critiques the High Court’s approach from an international and comparative perspective, contrasting it in particular with the jurisprudence in the United Kingdom and with instruments of the International Labour Organisation.
